1. Agreement to Terms

Welcome to Jalashka (“Company”, “we”, “us”, “our”). By visiting, browsing, or making a purchase on jalashka.com (“Website” or “Site”), you (“User”, “Customer”, “you”) confirm that you have read, understood, and agree to be legally bound by these Terms & Conditions (“Terms”), together with our Privacy Policy, Shipping Policy, and Return & Exchange Policy (collectively, the “Policies”).

If you do not agree with any part of these Terms, please do not use this Website or place any orders. Jalashka reserves the right to update these Terms at any time without prior notice. Continued use of the Website after any changes constitutes your acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Consumer Protection Act, 2019.

2. Eligibility

• You must be at least 18 years of age to use this Website and make purchases.
• By using this Website, you represent that you are legally competent to enter into a binding contract under applicable Indian law.
• If you are accessing the Website on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms.
• Jalashka reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion, including in cases of suspected fraud or misuse.

3. Use of the Website

3.1 Permitted Use

This Website is intended for your personal, non-commercial use only. You may browse, shop, and use features of the Website solely for lawful purposes and in accordance with these Terms.

3.2 Prohibited Use

You agree not to:

• Use the Website for any unlawful, fraudulent, or harmful purpose
• Attempt to gain unauthorised access to any part of the Website, server, or database
• Transmit any viruses, malware, or harmful code
• Scrape, crawl, or use any automated tools to extract data from the Website without written permission

• Place fraudulent, speculative, or bulk orders for commercial resale without prior written authorisation
• Abuse the return/refund system, including returning used, damaged, or switched items

Jalashka reserves the right to immediately suspend or permanently block any account found violating the above, and may take appropriate legal action.

4. Account Registration

• You may browse the Website as a guest. Creating an account is optional but recommended for a better shopping experience.
• You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with anyone.
• You are responsible for all activities that occur under your account.
• If you suspect unauthorised access to your account, notify us immediately at support@jalashka.com.
• Jalashka reserves the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

5. Products & Pricing

5.1 Product Information

• We take every care to display our products accurately. However, colours and textures may vary slightly from what you see on your screen due to device display settings — this does not constitute a defect.
• Product descriptions, size charts, and care instructions are provided for guidance purposes and are subject to revision without notice.
• Jalashka reserves the right to limit quantities, discontinue products, or modify product offerings at any time.

5.2 Pricing

• All prices displayed on the Website are in Indian Rupees (INR) and are inclusive of GST unless explicitly stated otherwise.
• Prices are subject to change at any time without notice. The price applicable to your order is the price at the time of checkout confirmation.
• In the event of a pricing error on the Website, Jalashka reserves the right to cancel any orders placed at the incorrect price, with a full refund.
• Jalashka is not obligated to honour erroneously displayed prices.

5.3 Promotions & Discounts

• Promotional codes and discount coupons are valid only for the period and conditions specified. They cannot be combined with other offers unless explicitly stated.
• Jalashka reserves the right to withdraw, modify, or expire any promotional offer at any time.
• Abuse of promotional offers (e.g., creating multiple accounts to redeem the same offer) will result in order cancellation and account suspension.
• Cashback or store credit issued as part of promotions is non-transferable and has no cash value unless otherwise stated.

6. Orders & Contract Formation

• Placing an order on Jalashka constitutes an offer by you to purchase the product under these Terms. The contract is formed only upon our acceptance, confirmed by an order confirmation email.
• Jalashka reserves the right to reject or cancel any order at any time before dispatch — including due to stock unavailability, pricing errors, payment failure, suspected fraud, or incomplete information — with a full refund of any amount paid.
• Order confirmation emails are automated and do not guarantee shipment. We will notify you if your order cannot be fulfilled.
• For COD orders, the contract is considered confirmed once the order is dispatched.

7. Payment Terms

• We accept UPI, Credit/Debit Cards, Net Banking, Digital Wallets, EMI (on eligible cards), and Cash on Delivery (COD) for eligible pin codes.
• All payments are processed through RBI-compliant, PCI-DSS certified payment gateways. Jalashka does not store your card or payment credentials.
• For COD orders, full payment is due at the time of delivery. Repeated refusal of COD orders may result in restriction of the COD facility on your account.
• In case of a payment failure, please do not attempt multiple payments. Contact us if an amount was debited without order confirmation.
• Jalashka is not liable for any bank charges, transaction fees, or currency conversion fees levied by your bank or payment provider.

7A. Store Credit & Gift Voucher Terms

• Store credit (“Jalashka Wallet”) is issued for approved returns, promotional rewards, or goodwill adjustments. It is non-transferable and has no cash value.
• Store credit is valid for 12 months from the date of issuance. Unused credit after expiry will lapse without reimbursement.
• Store credit may be applied to any order on jalashka.com, including sale items, unless a specific exclusion is communicated at issuance.
• Gift vouchers are similarly non-transferable, non-refundable, and cannot be exchanged for cash. They are valid only for the period specified on the voucher.
• Jalashka is not responsible for lost, stolen, or expired store credit or gift vouchers.
• In the event that Jalashka ceases operations, outstanding store credit will not be redeemable or refundable.

7B. Pre-Orders & Backorders

• Certain products may be offered for pre-order before they are available for dispatch. The expected dispatch date will be clearly indicated on the product page at the time of pre-order.
• Pre-orders are charged at the time of placement. If Jalashka is unable to fulfil a pre-order within 30 days of the indicated dispatch date, a full refund will be initiated.
• The 7-day return/exchange window for pre-order items begins from the actual date of delivery, not the order date.
• Jalashka reserves the right to cancel pre-orders due to production delays or discontinuation, with a full refund of any amount paid.

8. Intellectual Property Rights

All content on this Website — including but not limited to the brand name “Jalashka”, logo, design, photographs, product images, graphics, text, icons, and software — is the exclusive intellectual property of Jalashka and is protected under applicable Indian and international copyright, trademark, and design laws.

• You may not copy, reproduce, distribute, publish, display, transmit, or create derivative works from any content on this Website without prior written permission.
• You may not use Jalashka’s trademarks, logos, or trade dress in any manner that could cause confusion or disparagement.
• Any feedback, reviews, or suggestions you submit to us may be used by Jalashka without any obligation to compensate you.
• Unauthorised use of any Jalashka intellectual property will constitute infringement and may attract civil and criminal liability under the Copyright Act, 1957 and the Trade Marks Act, 1999.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law:

• This Website and all its content are provided “as is” and “as available” without warranties of any kind, either express or implied.
• Jalashka does not warrant that the Website will be uninterrupted, error-free, or free from viruses or other harmful components.
• Jalashka does not warrant that the product descriptions, images, pricing, or other content are accurate, complete, or current.
• Any reliance you place on information from this Website is strictly at your own risk.

10. Limitation of Liability

• To the fullest extent permitted by law, Jalashka shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Website or products purchased.
• Jalashka’s total liability to you for any claim arising out of or relating to these Terms or a purchase shall not exceed the amount you paid for the relevant order.
• Jalashka shall not be liable for delays or failures in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, government actions, strikes, or failure of third-party services (see Force Majeure, Section 14).
• Jalashka is not liable for the actions or omissions of third-party logistics partners, payment processors, or other service providers, though we will make reasonable efforts to assist you in resolving any issues.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jalashka and its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your violation of these Terms or any applicable law
• Your use or misuse of the Website
• Any content you submit, post, or transmit through the Website
• Your violation of any third party’s rights

12. Third-Party Links & Services

• The Website may contain links to third-party websites or services (e.g., payment gateways, social media platforms, logistics tracking). These are provided for convenience only.
• Jalashka does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party website.
• Your use of third-party websites is governed by their own terms and policies.

13. Governing Law & Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in [Your City, e.g., Pune / Mumbai — Required], Maharashtra, India.

13.2 Dispute Resolution

• Step 1 — Customer Support: Most issues can be resolved by contacting our support team at support@jalashka.com within the relevant timeframe.
• Step 2 — Grievance Officer: If unresolved, escalate to our Grievance Officer (see Section 16 of our Privacy Policy). We will respond within 30 days.
• Step 3 — Consumer Forum: You have the right to approach the National Consumer Disputes Redressal Commission (NCDRC) or state consumer forums under the Consumer Protection Act, 2019.
• Step 4 — Arbitration: For any remaining disputes, both parties agree to resolve them through binding arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement.

13.3 Consumer Protection (E-Commerce) Rules, 2020

Jalashka complies with the Consumer Protection (E-Commerce) Rules, 2020, including obligations around displaying seller information, grievance redressal timelines, and return/refund policies.

14. Force Majeure

Jalashka shall not be held responsible for any delay, failure, or disruption in services caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, floods, earthquakes, epidemics or pandemics, government-imposed lockdowns or restrictions, strikes, riots, war, fire, power failures, internet outages, or failure of third-party carriers or suppliers.

In such events, we will notify you as soon as reasonably possible and make every effort to fulfil your order or offer an appropriate remedy.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

16. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Exchange Policy, constitute the entire agreement between you and Jalashka with respect to your use of the Website and supersede all prior agreements, representations, and understandings.

• Thoughtful Packaging: We are actively working to reduce single-use plastic in our packaging and transition to more sustainable materials where possible.
• Quality Over Quantity: Our designs are made to last. We encourage customers to care for their garments as directed, extending their life and reducing waste.

16B. User-Generated Content & Social Media

We love seeing how you style your Jalashka pieces! When you post content featuring our products on social media:

• By tagging @jalashka or using our branded hashtags, you grant Jalashka a non-exclusive, royalty-free licence to repost or share your content on our social media channels, website, or marketing materials — with credit to you.
• You represent that the content you post is your original work and does not infringe any third party’s rights.
• If you do not wish your content to be reused, simply do not tag us or DM us to request removal of any previously shared content.
• Jalashka may use customer photos or reviews in advertising. We will always seek to credit the original creator.
